Knowing About Texas Credit Card Laws

Oftentimes a person will find himself suddenly in a large amount of credit card debt. This will usually quickly cause financial troubles, continual phone calls from collectors, even lawsuits filed against you. Texas credit card laws, though, help protect you against all this, providing very strict guidelines for companies. The following is an overview of some of these laws and what it can mean for you.

Unsecured and Secured Debt

It is important to understand the difference between two forms of debt. Secured debt is money owed on a specific, tangible thing, like buying a car or mortgaging a home. Unsecured debt is other money owed for a variety of items, such as purchases made on a credit card. Secured debt can be collected simply by repossessing the item in question. However, Texas does not allow unsecured debt to be collected in this way. A credit card company cannot take your property or assets in order to pay back a debt you owe. In fact, they are not even allowed to make threats of such actions, regardless of whether or not they carry the threats out.

Garnishing Wages

Many states will allow credit card companies to go to great lengths to obtain their money once they have won a settlement against a debtor, allowing garnishment of up to 25% of a person’s weekly paycheck. Texas does not allow this. Even after winning a settlement, Texas credit card companies are not allowed to garnish any amount of your wages to assure that you pay. The only thing they are permitted to do is take money directly out of your bank account. If you do not have a bank account, therefore, they cannot take any money from you, even if you lost the lawsuit.

Harassment

Texas also has strong laws against harassment by credit card companies. While federal law provides for preventing collection agencies from using illegal means of collection or continually harassing debtors, Texas law makes this even stricter by applying its own laws on top of the federal ones. Texas law does not permit creditors to call a debtor in such a way that the phone rings continuously, or to threaten to give a debtor any criminal charges. If a creditor breaks any of the harassment laws the debtor is allowed to sue for monetary damages.

Texas credit card laws lean heavily toward protecting the debtor. While credit card debt is a situation many of us find ourselves in unexpectedly, with these laws it is easier to negotiate a fair settlement and to know your rights as a debtor.
